      I think the way BoJack saw it is “well Todd doesn’t seem to be interested in her so I guess this is fair game”, which was evidently flawed thinking

    okay yes it was wrong Bojack ultimately slept with her, but Tod and Emily dated in HIGH SCHOOOL, and they are all adults now. Emily had made it clear that even though she is into Tod and will always care about him, she never understood how he felt about her. She was always supporting him in finding who he was and always there as a friend, which he made very clear he didn’t want anything more than that
