That’s an interesting question. I’ve definitely never seen it posed to this sub before. I’ll have to think about it.

Leaving poor Tom in prison who just needed $50 bail and constantly patiently calling to ask for help as things increasingly got more dangerous for him as BJ continually didn’t even blow him off, he continually didn’t even listen enough to actively blow him off was pretty horrible.

Not the worse but sabotaging Todd’s rock opera was pretty shifty. Or sleeping with the girl that liked Todd. I forget her name.

the last 2 he was strung out/not sober. not that that makes it any better, but to me amplifies the severity of what happened w penny as he was sober that whole time in new mexico & still did what he did

New Mexico.

For the 17 minutes, he was high on heroin and other drugs and in a panic state.

In New Mexico, he was mildly buzzed at best (with respect to his normal alcohol consumption) and far more conscious of his actions.

I would’ve said 17 minutes but truth be told it’s entirely possible he didn’t even know 17 minutes had passed until he was told about it. The show and even that very episode establishes that his perception of time is warped as shit during his benders. It’s entirely possible that to Bojack, the amount of time he spent wasn’t more than 2 or 3 minutes.

That said, what he did during those 17 minutes (covering his tracks) is imo his worst crime. I’m not really sure I can think of anything worse.

If anything did end up happening in New Mexico I’d have gladly said sleeping with Penny though.
